As you can see, in Virginia, theft charges are based on the value of the items taken. If the value is $200 or greater, the charge is a felony. If the value is less than $200, the charge is a misdemeanor. Most felony Larceny convictions carry a maximum penalty of up to 20 years in prison. Misdemeanor Larceny convictions carry a potential jail sentence of up to 12 months.

Most often the Defense of Larceny charges center around the intent element. We set out to show there was no intent to permanently deprive the owner of the property. Also, we challenge the value of the items taken. This is particularly important when the items taken are not new. Also, when dealing with receiving stolen property, we attempt to prove that you didn’t know the items were stolen when you received them.
