Virginia Drug Possession penalties can be very harsh. If convicted, you could be facing years in prison, large fines and mandatory loss of your right to drive.

 

To be found guilty of possession, the prosecutor must prove beyond a reasonable doubt the following:

 

  1. The defendant knowingly and intentionally possessed a controlled substance (without a valid prescription),
  2. The defendant knew the character and nature of the substance (i.e. that it was an illegal substance) and,
  3. The defendant actually controlled or possessed the drug.

 

Virginia Drug Classifications

 

  • Schedule I: Heroin, ecstacy (MDMA), LSD
  • Schedule II: Cocaine, Methamphetamine (Crystal Meth.), PCP, Methadone
  • Schedule III: Tylenol with Codeine or Hydrocodone, Anabolic Steroids
  • Schedule IV: Prescription drugs such as Valium, Rohypnol, Xanax
  • Schedule V: Prescription cough medicines with Codeine

 

Virginia Drug Possession Penalties

 

  • Schedule I: Up to 10 years in prison and fines up to $2500
  • Schedule II: Up to 10 years in prison and fines up to $2500
  • Schedule III: Up to 12 months in jail and fines up to $2500
  • Schedule IV: A fine of up to $500
  • Schedule V: A fine of up to $250
